Appeal Court Dismisses Atiku’s Suit Against INEC, Tinubu, rejects 2 motions filled by the PDP

 

The Presidential Election Petition court in Abuja has rejected two motions filed by the Peoples Democratic party and its presidential candidate Atiku Abubakar against the Independent National Electoral Commission (INEC), President-elect Bola Tinubu, and the All Progressives Congress.

 

In the first motion marked CA/PEC/13m/2023, Atiku and the PDP requested the court’s permission to observe the reconfiguration of the Bimodal Voter Accreditation System (INEC) machines by INEC officials.

While the second motion (exparte) filed on March 14 sought an order from the court to serve court documents on Tinubu and the APC by substituted means, namely by serving their papers on their staff or posting it on their premises.

Ifeanyi Iboko, solicitor for the PDP, stated that he had filed a notice of discontinuance during Wednesday’s hearing.

He explained that he is withdrawing the motions because they have been rendered obsolete by recent events.

The Appellate Court ruled, “Motion exparte being withdrawn, it is hereby dismissed.”

Idoko told Ejes Gist News Nigeria that the purpose of the motion was to observe INEC’s reconfiguration of BVAS, but since the court had already granted INEC permission to proceed with reconfiguration, “we felt there was no need to continue the motions.”

Remember that the Independent National Electoral Commission (INEC) declared Bola Tinubu, the presidential candidate of the All Progressives Congress (APC), to be the winner of the presidential election held on February 25.
