Appeals Osun Election Tribunal Judgement

The Independent National Electoral Commission is appealing the decision made by the Election Petition Tribunal in Osun State, which was led by Justice T. A. Kume, on 44 different grounds.

The petition was sent to the Court of Appeal in Akure on Wednesday by INEC’s lawyer, Paul Ananaba, who is a Senior Advocate of Nigeria.

The electoral body said that the election petition tribunal broke the law by not taking into account and ruling on the various preliminary objections filed by the first respondent.

These objections questioned the legitimacy of the petition and the right of the election petition tribunal to hear the petition.

Instead, the election petition tribunal went on to decide whether or not the petition had any merit.

Former Governor of Osun State Adegboyega Oyetola and his party, the All Progressive Congress, filed a petition against the electoral body’s decision to name People Democratic Party candidate Ademola Adeleke as the winner of the July 16 governorship election in the state.

Oyetola said that APC’s petition, with the reference number EPT/OS/GOV/01/2022, was based on Adeleke’s eligibility to run and overvoting, and on January 27, 2023, the Tribunal said that Oyetola was the legally elected Governor of the state.

The person who filed the appeal said that the Tribunal completely misunderstood Section 47(2) of the Electoral Act of 2022, which must be read with purpose, in context, and as a whole to get to the true intent of the law and justice.

INEC asked the Appeal Court to tell the trial court to throw out its whole decision and to dismiss and/or strike out the petition because it didn’t have the right to do so.
