Breaking: Appeal Court Restores Ademola Adeleke as Osun Governor
The Court of Appeal Abuja has set aside the decision of the Osun State Governorship tribunal, and has upheld the Governorship of senator Ademola Adeleke.
The Election Petition Tribunal stated that Adeleke did not receive a majority of lawful votes during the 16 July governorship elections in the state, and therefore dismissed him from office.

However, in a unanimous decision by a three-person panel led by Justice Mohammed Shuaibu, the Court of Appeal overturned the tribunal’s ruling and reinstated Adeleke as governor of Osun State.
The panel of the Appeal Court revoked the tribunal’s order that Adeleke’s certificate of return be revoked and issued to Oyetola.

The panel upheld the issue of BVAS raised against Oyetola, stating that the Osun State tribunal was incorrect to have stated that there was overvoting, a claim that was based solely on the evidence presented by Oyetola and the APC, and therefore does not prove their case.

The court ruled in favour of Adeleke on the issue of jurisdiction, citing section 285(8) of the amended Constitution as justification for its authority to hear the appeal.

In addition, the court awarded N500,000 in damages against the All Progressive Congress and its candidate, Gboyega Oyetola.
