The plaintiffs claim that when the aforementioned provisions of the African Charter and the Constitution of the Federal Republic of Nigeria are taken together, “states will be held responsible if they fail to act with due diligence to prevent violations of the rights or actively participate in acts which amount to a violation of the plaintiff right (as in this case), and for providing adequate compensation.”

The Plaintiffs also claim that the Respondent violated the deceased’s right to life, dignity of her person, and security “under the combined provisions of Articles 1, 4, and 5 of the African Charter on Human and Peoples’ Rights to which Federal Republic of Nigeria is a signatory.”

An order directing the defendant to pay the applicants $10 million as compensation for the unlawful killing of Alhaja Kudirat Abiola is one of the demands made by the plaintiffs in the Community Court.
The court hearing for the lawsuit has not yet been scheduled.
