Mahmood Yakubu: Court Stops DSS From Arresting INEC Chairman
An application to remove Prof. Mahmood Yakubu, the chairman of the Independent National Electoral Commission (INEC), from office due to an alleged false asset declaration was dismissed by the FCT High Court.
On Wednesday, Justice M. A. Hassan rejected the claimants’ 14 requests for relief in addition to the application.
Prof. Yakubu’s asset declaration was deemed legal, valid, and compliant with the law by the judge.
He prohibited the Nigeria Police, the Code of Conduct Bureau (CCB), and the Department of State Services (DSS) from detaining Yakubu.

The decision was made in response to an initial summons filed by Somadina Uzoabaka against Prof. Mahmood Yakubu and the Attorney General of the Federation, with the filing number FCT/HC/GAR/CV/47/2022. Uzoabaka sought, among other things, an order of mandatory injunction compelling the INEC chairman to recuse, excuse, and exclude himself and/or resign as chairman of INEC pending the investigation and review of the various allegations.
In addition, the plaintiff requested a court order prohibiting the INEC chairman from assuming or holding any public office for a period of ten years.

In response to the allegation, Prof. Yakubu provided information about his court filings, exhibits demonstrating the sources of funding for the purchase of the properties that the plaintiff claimed were illegally acquired, and he insisted that his asset declarations were properly completed.
