The decision was made in response to an initial summons filed by Somadina Uzoabaka against Prof. Mahmood Yakubu and the Attorney General of the Federation, with the filing number FCT/HC/GAR/CV/47/2022. Uzoabaka sought, among other things, an order of mandatory injunction compelling the INEC chairman to recuse, excuse, and exclude himself and/or resign as chairman of INEC pending the investigation and review of the various allegations.
In addition, the plaintiff requested a court order prohibiting the INEC chairman from assuming or holding any public office for a period of ten years.
