Appeal Court postpones judgement on Osun Governorship appeal

 

On Monday, the Appeal Court postponed its decision on the Osun State Governorship Appeal filed by Governor Ademola Adeleke.

 

Adeleke had filed an appeal on February 9 against the ruling of the Osun State Governorship Tribunal, which invalidated his election and ruled in favour of the state’s former governor, Gboyega Oyetola.

Gov. Adeleke petitioned the court to overturn the Osun State tribunal’s decision, describing it as a “miscarriage of justice.”

Nonetheless, when the tribunal ruled in favour of the former governor of the state, Gboyega Oyetola, two of the three members of the tribunal panel determined that Oyetola had established that there was overvoting in some of the polling units.

 

But weeks later, Adeleke filed an appeal with the Akure division of the Court of Appeal on the 31 grounds of appeal, requesting “an order reversing the entire tribunal’s decision.”

The governor seeks “either an order striking out the petition for lack of competence and jurisdiction, or an order dismissing the petition on the merits.”

Adeleke stated, “The second respondent cannot ‘go lo lo lo lo’ and ‘buga won’ as the legitimately elected governor of Osun state.”

“The tribunal erred in law and displayed bias against the appellant when, in its judgement, it made reference to the appellant’s dance at his inauguration as governor of Osun State, which was never an issue before the lower tribunal,” the governor stated.

 

“By making reference to the appellant’s personal eccentricity for dancing, the lower tribunal ridiculed and mocked him in a way that suggested it was biassed against him.

 

“The appearance of bias in reference to the Appellant’s fondness for dancing, particularly the Buga song, has rendered the lower Tribunal’s decision null and void.

 

“In its ruling, the tribunal erred in law by returning the 1st respondent as the duly elected candidate without taking into account the large number of voters in the units where the results were voided due to overvoting.”
