Judge threatens bench warrant against Fani-Kayode

On Wednesday, a Lagos State Special Offences Court sitting in Ikeja threatened to declare an ex-minister of aviation, Femi Fani-Kayode, wanted for failing to appear for his trial.

Economic and Financial Crimes Commission is prosecuting Fani-Kayode on 12 counts related to the use of false documents, the use of fabricated evidence, and procuring the execution of documents under false pretence.

The ex-minister allegedly submitted forged medical reports to Justice Daniel Osiagor of the Federal High Court in Lagos, where he is being prosecuted for an alleged N4.9 billion fraud by the EFCC.

Justice Olubumni Abike-Fadipe, dissatisfied with Fani-Kayode’s refusal to appear before the court to face his trial following his arraignment on December 17, 2021, and subsequent adjournments, issued the threat on Wednesday when the matter was brought up.

At the last adjourned date, Fani-Kayode’s attorney, Mr. Wale Balogun, informed the court of his client’s absence, citing ill health. According to Mr. Balogun, this was related to Fani-Kayode’s encounter with the Department of State Services, which interrogated him over comments made prior to the general elections.

Balogun had pleaded with the court for an adjournment, promising to be present for Wednesday’s proceeding.

However, at the resumption of the hearing on Wednesday, Fani-Kayode’s attorney, Mr. Chinozo Eze, informed the court that his client was absent due to health concerns.

He informed the court that a medical report and a letter requesting permission to cancel the two dates were already on file.

EFCC Counsel Zinat Atiku confirmed the development and stated that the prosecution was unable to move forward.

However, the judge frowned upon the defendant’s repeated absences, noting that his last court appearance was on November 4, 2022.

The judge cited a number of Fani-Kayode’s justifications for his absence from court to face his trial.

Therefore, Justice Abike-Fadipe threatened to issue a bench warrant if he did not appear at the next adjourned date.

The judge also criticised the prosecutor for his lack of diligence in prosecuting the case, noting that anti-corruption could have withdrawn the case if it was not prepared to prosecute it.
