The Federal High Court in Abuja has set a date for a ruling on Friday with regards to an ex-parte application filed by three individuals. The application seeks to prevent the President-elect, Bola Tinubu, from being inaugurated on May 29th until the Presidential Election Petition Court (PEPC) has resolved the pending petitions.

During Tuesday’s proceedings, Justice James Omotosho scheduled the ruling following arguments presented by the applicants’ legal representative, Oliver Eya. Prior to adjourning the session, Justice Omotosho instructed the applicants’ counsel to adequately prepare arguments on three key matters during the next court session.

The matters in question include determining the jurisdiction of the court to hear the case, establishing the standing of the plaintiffs to initiate the lawsuit, and verifying whether the plaintiffs have any legal entitlements that they aim to protect through this legal action.
The applicants, identified as Praise Ilemona Isaiah, Pastor Paul Isaac Audu, and Anongu Moses, claim to be Nigerian citizens eligible to vote. They have filed a motion for interlocutory injunctions, seeking to halt the inauguration process until a decision is reached on their motion.

The petitioners have requested the court to grant an order of interim injunction restraining the 2nd respondent, Bola Tinubu, from assuming the office of the President of the Federal Republic of Nigeria until the hearing and determination of the motion on notice that has already been filed.
In the main lawsuit, Isaiah, Audu, and Moses allege that Tinubu provided false information regarding his citizenship status and date of birth.
The defendants named in the lawsuit, referenced as FHC/ABJ/CS/657/2023, include the President of the Federal Republic of Nigeria, Bola Ahmed Tinubu, the All Progressives Congress (APC), the Attorney General of the Federation (AGF), and the Director-General of the Department of State Services (DSS). Notably, the Inspector General of Police (IGP) and the Independent National Electoral Commission (INEC) are also significant entities involved.
