Atiku Files Appeal Against Tribunal’s Decision Upholding President Tinubu’s Victory

Abubakar Atiku, the Presidential Candidate of the Peoples Democratic Party (PDP), has lodged an appeal against the judgment of the election petition tribunal, which affirmed the election of President Bola Tinubu. In a 35-ground notice of appeal submitted on Tuesday, Atiku asserted that the tribunal had “committed a grave error” in its judgment.

The appeal, filed by Atiku’s lead counsel, Chris Uche, SAN, requests the Supreme Court to overturn the findings and conclusions of the Tribunal. Atiku argues that these findings did not accurately represent the essence of his petition.

Among other claims, Atiku contended that the Tribunal erred in law by failing to annul the presidential election held on February 25, 2023, due to non-compliance with the Electoral Act of 2022. He pointed to evidence before the tribunal indicating that the Independent National Electoral Commission conducted the election based on grave and gross misrepresentation, contrary to the principles of the Electoral Act of 2022, founded on the “doctrine of legitimate expectation.”

This appeal marks a significant development in the post-election legal proceedings, with the legal battle intensifying as it proceeds to the Supreme Court. The final outcome of this dispute over the presidential election will ultimately rest in the hands of the highest court in the land.
