Breaking: Appeal Court Sacks Governor Caleb Muftwang, Declares APC Candidate Winner

The Court of Appeal in Abuja has invalidated the election of Governor Caleb Muftwang in Plateau State.

The three-member panel, in a unanimous decision on Sunday, ruled that Muftwang was not legitimately sponsored by the Peoples Democratic Party (PDP), citing a violation of Section 285(2) of the Nigerian Constitution.

The court went further to proclaim Nentawe Yilwatda of the All Progressives Congress (APC) as the rightful winner of the March 18 Plateau State Governorship Election. The decision was grounded in the argument presented by the appellant, Goshwe, who asserted that the PDP’s failure to comply with court orders regarding congresses constituted a breach of the law.

The panel nullified the judgment of the Governorship Election Petitions Tribunal, deeming it “highly inconsistent” and a violation of fair hearing due to its reliance on expunged witness statements.

Consequently, the court instructed the Independent National Electoral Commission (INEC) to revoke Governor Caleb Muftwang certificate of return and issue a new one to Goshwe, emphasizing the appellant’s entitlement to be returned as governor.

This ruling underscores the imperative for political parties to adhere to legal procedures, including valid ward, local government, and state congresses, before nominating candidates for elective positions.
