Contempt of Court: , Usman Baba Faces Fresh Jail Threat Over Contempt

IGP Usman Baba will soon be the subject of a new contempt case for allegedly violating a citizen’s basic human rights.

This is because the police disregarded the directive regarding Justin Maduagwu’s rights as managing director of the Nigeria-Ukraine Chamber of Friendship, Culture, and Commerce.

Malachy Nwaekpe, the attorney for Maduagwu, filed a notice of contempt proceeding under Form 48 on December 13 in an effort to compel the IGP to abide by a court order issued on December 14, 2017 directing him to pay Maduagwu a total of N91,452,750.

At the time the order was issued, IGP Usman was not in charge of the Nigeria Police Force.

The amount awarded in the judgement is N81.4 million, plus N10 million in costs and damages for the applicant’s property that was “illegally and compulsorily confiscated, seized, and acquired” by the police.

On December 14, 2017, a Federal High Court in Abuja issued a ruling on the enforcement of fundamental rights, finding that the applicant’s seven-day detention without charge and the confiscation of his property were in violation of sections 35 and 44 of the 1999 Nigerian Constitution.

In a letter received on June 21, 2018, the Director of the Citizens Rights Department of the Attorney General of the Federation and Minister of Justice advised the IGP to comply with the judgement by “a preventing a continuous increase of the judgement debt.”

Recall that the IGP was sentenced to prison for contempt by a Federal High Court in Abuja during the year.

The IGP was sentenced to three months in prison on November 29, 2022 by the court for disobeying a previous order directing Patrick Okoli, a compulsorily retired police officer, to be rehired.

The Federal High Court later withdrew the case.
