Adamawa Saga: Court Refuses To Hear Binani’s Motion

 

In a recent development, the Federal High Court located in Abuja has reportedly rejected the ex-parte motion that was filed by Senator Aisha Ahmed, who is more commonly known as Binani. The motion was filed by the All Progressives Congress (APC) candidate in the Adamawa governorship election.

In a recent court proceeding, Justice Inyang Ekwo declined to entertain the motion presented before him. Rather, he instructed Binani’s legal representative, Mohammed Sheriff, to first address the court on the matter of jurisdiction before proceeding to hear the substantive motion.

During the hearing, Afeez Matomi made an appearance for Governor Ahmadu Fintiri, who is the third respondent in the lawsuit. Matomi announced his appearance shortly after his name was mentioned by the Sheriff. During the court proceedings, Justice Ekwo inquired from Matomi whether he had received the necessary legal documents. According to the lawyer’s statement in court, they have filed a motion to counter a portion of Binani’s prayers, despite not having been served yet.

 

According to his statement, they became aware of the ex-parte motion through social media and subsequently took action by filing a motion. The judge, who refused to hear Fintiri’s attorney, emphasised the importance of adhering to the law. Following Ekwo’s directive, Sheriff was instructed to address the court.

According to the lawyer, an ex-parte motion was filed on April 17 and he is prepared to proceed with it. The judge has stated that he is prepared to hear from Sheriff, however, he has requested that the lawyer first address the court on the matter of jurisdiction before proceeding. In a recent development, Justice Ekwo has ruled that the application will be considered alongside the issue of jurisdiction on the upcoming adjourned date.

The presiding official has made the decision to postpone the issue until April 26th, where the motion will be heard and a jurisdictional address will be given. In a recent legal development, Binani and the APC have filed a motion ex-parte, identified as FHC/ABJ/CS/510/2023, against the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP), and Governor Fintiri, who is the 3rd respondent in the case.

In a bid to challenge the administrative decision of the Independent National Electoral Commission (INEC), which declared her as the winner of the March 18 governorship election and the supplementary poll of April 15, Binani, represented by her lawyer, Hussaini Zakariyau, SAN, has sought a judicial review.
