High Court in Lokoja Restrains EFCC from Infringing on Yahaya Bello’s Rights

 

A High Court sitting in Lokoja, Kogi State, has issued a restraining order against the Economic and Financial Crimes Commission (EFCC) to prevent any infringement on the fundamental human rights of former Governor Yahaya Bello.

In a significant ruling delivered on Wednesday at High Court 4, presided over by Hon. Justice I.A Jamil, in suit number HCL/68/M/2020, the court barred the EFCC from undertaking actions such as arresting, detaining, or prosecuting Bello, except as authorized by the court. This order follows an earlier interim injunction.

The judgment stemmed from a suit brought before the court by Bello, seeking to uphold his fundamental rights against the EFCC’s actions. In addition to restraining the EFCC from taking further action against Bello, the court also prohibited the respondents from continuing to persecute the applicant. The EFCC’s challenge regarding jurisdiction was dismissed by the court during the proceedings.

Legal counsels representing both parties expressed their views on the judgment. The Applicant’s Counsel, SA Abbas and MS Yusuf, hailed the judgment as a landmark decision, while the Defendant Counsel, T.U Odima and Patrick O. Jibril, concurred with the judgment’s thoroughness.
