Court Issues Criminal Summons Against Sen Ifeanyi Ubah

 

Senator Ifeanyi Ubah and his company, Capital Oil and Gas Limited, have been served with criminal summonses by the Federal High Court in Lagos.

Justice Nicholas Oweibo issued this directive in the criminal prosecution of the Senator by the Federal Government of Nigeria on an 8-count charge relating to his alleged indebtedness to Asset Management Corporation of Nigeria, AMCON sometime in 2019, which includes conspiracy in making false claims in relation to the actual values of certain assets transferred to AMCON under a consent judgement obtained in 2012 in violation of Section 54(1).

The prosecutor, Mr. Tunde Lawal of the law firm Kunle Adegoke SAN & Co, informed the court on Tuesday during the suit’s proceedings that the defendants had been served with the amended charge and hearing notice for today. He also informed the court that Senator Ifeanyi Ubah was not present at the last adjourned date, despite being served with hearing notice.

On this basis, he requested that a bench warrant be issued against Senator Ubah.

Mrs. Ifeoma Esom, counsel for the defendants, informed the court that the matter was for report of settlement/plea and that they had just been informed this morning that settlement had failed; the 1st Defendant was not present because settlement had failed.

The prosecutor objected on the grounds that a settlement cannot be reported on this matter because it is a criminal matter, noting that the parties are free to settle outside of court, but that this cannot become part of the court’s business.

In addition, he stated that the best possible outcome is a plea bargain, and that such negotiations outside of court do not give the first defendant, Senator Ubah, permission to miss court.

After hearing the parties’ arguments, the court declined to issue a bench warrant but ordered that Senator Ifeanyi Ubah be summoned through his attorney to appear in court on the next adjourned date.

The court also stated that if Senator Ubah fails to appear at the next adjourned date, an arrest warrant will be issued for him.

The arraignment of Senator Ubah has been postponed until the 18th of October by Justice Oweibo.
