Federal High Court to Deliver Judgment on Rivers Assembly, Fubara Suit Today

 

In a significant legal development, the Federal High Court in Abuja is poised to deliver judgment today in a suit brought forth by the Speaker of the Rivers State House of Assembly, Martin Amaewhule. The case involves Governor Siminalayi Fubara, the National Assembly, and other key figures.

The impending judgment announcement was confirmed through a notice sent to all concerned parties on Sunday. This legal matter, marked FHC/ABJ/CS/1613/2023, sees the Rivers State House of Assembly and Amaewhule as the plaintiffs.

The defendants encompass prominent figures in the National Assembly, including the Senate President, Deputy Senate President, Senate Majority Leader, Senate Minority Leader, House of Representatives Speaker, House Deputy Speaker, House Majority Leader, House Minority Leader, and the Clerk to the National Assembly.

Additional defendants include the Governor of Rivers State, Attorney-General of Rivers, Commissioner of Finance, Accountant-General of Rivers, Rivers State Civil Service Commission, Inspector-General of Police, and Edison Ehie.

The crux of the plaintiffs’ case seeks an injunction preventing the defendants from entertaining any request from Governor Fubara to assume the functions of the Rivers State Assembly. This includes its legislative competence to make laws for the peace, order, and good government of Rivers.

Furthermore, the plaintiffs aim for an injunction restraining Governor Fubara from obstructing or hindering the assembly under Speaker Amaewhule’s leadership.

Presiding over the matter is Justice James Omotoso, with the case initiated during a period of heightened crisis in the state. The discord stemmed from strained relations between the former governor of the state and the FCT minister, Nyesom Wike, and Governor Fubara.

 

A pivotal meeting on December 18, convened by President Bola Tinubu, brought Wike and Fubara together to sign an eight-point resolution aimed at resolving the political crisis.
